Exciting news in Florida when Judge Sara Zabel of Miami-Dade County lifted the stay on her own ruling in a case in which same-sex couples challenged the marriage ban. With the legal recognition of same sex marriage now they should be able to enter into a gestational agreement no longer having to adopt back their biological child.
The Florida Gestational Surrogate Law, Statute 742.15, stipulates that married intended parents entering this agreement must be a married man and woman. Now that same-sex marriage is legal in Florida the Court systems should allow for married gay couples to utilize this statue.
With Miami-Dade being a day ahead of issuing marriage licenses for same-sex couple Broward County was right behind issuing marriage licenses on January 6th at 12:01 a.m. A mass wedding took place at the courthouse as well. Palm Beach County had a mass wedding the same day at Broward County.
